Official Rules
THIS SWEEPSTAKES IS INTENDED FOR PLAY IN THE UNITED STATES ONLY AND PARTICIPATION IS GOVERNED BY U.S. LAW. DO NOT ENTER IF YOU ARE NOT ELIGIBLE AND NOT CURRENTLY LOCATED IN THE UNITED STATES.
1. SWEEPSTAKES Sponsor and administrator: Sponsor: Agri-Fab, Inc., 809 South Hamilton Street, Sullivan, IL 61951; Administrator: Promotion Activators, Inc., 1851 Elmdale, Glenview, IL 60026. This promotion is not sponsored by any other entity other than Agri-Fab, Inc.
2. ELIGIBILITY: The Agri-Fab “Gridiron Getaway Hawaii” Sweepstakes (“Sweepstakes”) is open to individuals who are at least 25 years of age and are legal residents of the 50 United States or the District of Columbia (“D.C.”) at the time of entry. Void outside the 50 United States, D.C., and where prohibited by law. Employees of Sponsor and Administrator, and their parent companies, affiliates, subsidiaries, agents, retailers, advertising, promotion, and judging agencies and members of the immediate families or households of any of the above are NOT eligible to participate. For purposes of these rules, “immediate families” means parents or legal guardians, siblings, children and spouse and "step" of each.
3. ENTRY PROCEDURE: NO PURCHASE NECESSARY TO PARTICIPATE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Sweepstakes begins at 12:00:01 AM Central Time (“CT”) on June 9, 2008, and ends at 11:59:59 PM (CT) on July 31, 2008 (“Promotion Period”). Go to http://www.agri-fab.com// and follow the on-screen instructions to enter the Sweepstakes. All entries must be received by 11:59:59 PM (CT) on July 31, 2008. Limit one (1) entry per person/household. Entries become property of the Sponsor. Entries will not be returned or acknowledged except as provided herein.
4. PRIZE WINNER SELECTION: Winners will be selected in a random drawing from among all eligible entries received, on or about August 7, 2008, by Promotion Activators, Inc., an independent judging organization (“Judges”) whose decisions shall be final on all matters related to this Sweepstakes. Odds of winning depend on the total number of eligible entries received in accordance with these Official Rules. To obtain a list of prize winners, entrants must send a self-addressed stamped envelope to: Agri-Fab “Gridiron Getaway Hawaii” Sweepstakes Winners, 1851 Elmdale, Glenview, IL 60026. Requests must be received by September 30, 2008.
5. PRIZE: One (1) Grand Prize: a three (3) day/two (2) night trip for two (2) persons (winner and one guest) to Honolulu, HI from February 7 to February 9, 2009. Prize includes round trip coach air transportation for the winner and his/her guest from the major commercial airport nearest the winner’s home to Honolulu, HI, two (2) nights standard hotel accommodations (one room, double occupancy), three (3) day car rental (eligible drivers only), and $500.00 cash which may be used by the winner to purchase tickets to a game. Winner must be available to travel on the selected trip dates designated by Sponsor or prize will be forfeited. Approximate retail value: $4,500.00. Actual value varies depending upon location of winner’s home and airfare fluctuations. All other expenses not specifically mentioned herein as part of a prize are solely the responsibility of the prize winner, including but not limited to gratuities, meals, beverages, and ground transportation (except as specified herein). All travel is subject to availability, blackout periods, government restrictions and regulations, hotel, airline, airport or other transportation terminal (or other types of transportation) restrictions and regulations. Other restrictions may apply. Sponsor assumes no responsibility for cancelled, delayed, suspended or rescheduled events (including but not limited to airline flights beyond its control). Winner and guest must have all necessary identification and/or travel documents required for travel within the United States, and must travel together on the same itinerary.
6. GENERAL: Grand Prize winner will be notified by overnight mail and will be required to complete and return an affidavit of eligibility and liability/publicity release (where permitted by law) within seven (7) days of receipt of notification or prize may be forfeited and (time permitting) awarded to an alternate winner selected as described in Section 2 above. Winner’s guest must also complete and return a liability release and publicity release within the same seven (7) day period as a condition of accompanying winner on trip. Guest must be of the age of majority in his/her state of residence, unless accompanied by a parent or legal guardian who is the winner. Return of any prize or prize notification as undeliverable, or failure of the winner to return required documents in a timely manner, or failure to comply with these Rules in any way, will result in forfeiture of prize and (time permitting) the selection of an alternate winner selected as described in Section 2 above. Prize must be accepted as awarded. Except where prohibited by law, acceptance of prize constitutes permission to use information on winner's name, hometown, likeness, photograph, statements made by winner about the promotion and/or prize for advertising and publicity purposes in all media worldwide without limitation and without additional compensation. By participating in this Sweepstakes, entrants agree to be bound by the Official Rules and the decisions of the Judge and to release Sponsor, its related companies, and their respective subsidiaries, affiliates, advertising, promotion, judging agencies, directors, officers, prize suppliers, employees, and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with participation in the Sweepstakes, or the downloading or accessing of entry materials, or the acceptance, possession or use/misuse of any prize awarded herein, or travel to or from the professional football game or other events related to the prize, including but not limited to any services provided by parties other than Sponsor in connection with the prize awarded, or participation in, any prize-related activity (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light). The winner will be responsible for all federal, state and/or other income taxes on prize. Prizes are non-transferable and no substitutions or cash redemptions will be made except as provided herein or at the Sponsor’s sole discretion. Winners must comply with all Sweepstakes rules as published. If winner is found to be in violation of any of these rules he/she will be required to forfeit his/her prize, or, at Sponsor’s discretion, to reimburse Sponsor for the value of the prize if such violation is found after the prize has been used. If the prize is forfeited for any reason and time permits, an alternate winner will be drawn at random by the judge from the remaining eligible entries and awarded the prize. Sponsor reserves the right to substitute any listed prize for one of equal or greater value if the designated prize should become unavailable for any reason.
7. INTERNET TERMS: The use of any automated launching or entry software or any other mechanical or electronic means that permits the participant to automatically enter repeatedly is prohibited. If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right at their sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes. In the event that the Sweepstakes is cancelled or terminated prior to the stated end date, the Sponsor reserves the right to have the Judge select the winners for the Sweepstakes in a random drawing from among all eligible, non-suspect, entries received prior to the time of the action or event warranting such cancellation/termination. Proof of entering information on Sponsor’s website is not considered proof of delivery or receipt by Sponsor. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers or service providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a potential winner based on an e-mail address, the potential winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
